UK-EU Trade marks – No deal Brexit – UK legal changes

On 1st March 2019, the UK IPO announced the UK is amending existing trade marks legislation. In the event of the UK leaving the EU without a deal, all existing EUTMs will cease to provide protection in the UK. However, UK law is being amended to ensure UK protection conferred by prior registered EUTMs is preserved, for a time at least. The legal changes aim to give holders of prior registered EUTMs a comparable national UK mark. The Office has introduced The Trade Marks (Amendment etc.) (EU Exit) Regulations 2019 under the powers of the European Union (Withdrawal) Act 2018.
